Agreement between User and iconfit.com
Welcome to iconfit.com. The iconfit.com website (the “Site”) is comprised of various web pages operated by Icon Fit Clubs LLC and/or Icon Fit L.A. LLC (“IconFit”). iconfit.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of iconfit.com constitutes your agreement to all such Terms. Please read these terms carefully and keep a copy of them for your reference.
iconfit.com is an informational Site. It provides information about the services, facilities, location, classes, and memberships offered by IconFit at 12100 W. Olympic Blvd., Suite 100, Los Angeles, California 90064. The Site is not itself a membership agreement, a day-pass agreement, or a liability waiver.
Privacy
Your use of iconfit.com is subject to IconFit’s Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.
Electronic Communications
Visiting iconfit.com or sending emails to IconFit constitutes electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically, by email and on the Site, satisfy any legal requirement that such communications be in writing, to the extent permitted by law. Consent to telephone calls and text messages is separate and is described below. A visit to the Site, by itself, is not consent to receive marketing text messages.
Text Messages and Phone Calls
IconFit does not operate a mass text-message campaign. If you submit your name, email address, and phone number on the Site and ask us to contact you — for example, to schedule a visit, request a day pass, or ask about membership — we may contact you by email and phone about that request. We may also send text messages (SMS or MMS) about that request only if you give the separate consent below.
Text-message consent must be clear and affirmative, such as an unchecked box on the form that is not required to submit the form. The box and the disclosure next to it should use language substantially like the following:
“By checking this box, I agree to receive text messages from IconFit at the mobile number I provided, including messages about my inquiry and related membership, class, visit, or day-pass information. Message frequency varies. Message and data rates may apply. Reply STOP to cancel and HELP for help. Consent is not a condition of purchasing a membership or any other product or service. See the Privacy Policy and Terms of Use.”
By opting in, you authorize IconFit to send those messages using an automatic telephone dialing system or other automated technology, to the extent we use that technology. You represent that you are the subscriber or customary user of the mobile number, that the number is a mobile number, and that you are 18 years of age or older. You agree that we may rely on the form record, including the time of submission and the disclosure presented, as your written consent.
You may revoke consent at any time by replying STOP to a text message, by emailing info@iconfit.com, or by calling (310) 836-8000. After you text STOP, we may send one message confirming the opt-out. Opting out of texts does not opt you out of emails, and unsubscribing from emails does not opt you out of texts. Message frequency varies and depends on your inquiry and our follow-up. It is not a recurring promotional blast list. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. Reply HELP for help or contact us at the number or email above.
Consent to texts or calls is not required to visit the Site, to email us, or to purchase a membership in person. If you provide a phone number but do not check the text-message box, we may still respond by phone or email about the request you submitted, but we will not send marketing text messages.
Children Under Thirteen
IconFit does not knowingly collect, either online or offline, personal information from persons under the age of thirteen through the Site. If you are under 18, you may use iconfit.com only with permission of a parent or guardian. Do not submit a form on behalf of a child under 13.
Links to Third Party Sites/Third Party Services
iconfit.com may contain links to other websites (“Linked Sites”). The Linked Sites are not under the control of IconFit and IconFit is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. IconFit is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by IconFit of the site or any association with its operators.
Certain features of the Site, such as hosting, forms, maps, security checks, message delivery, Google advertising tags, and the Meta Pixel, are supported by third-party providers. By using the Site, you acknowledge that those providers may receive the information described in the Privacy Policy, including technical and usage information used to operate the Site and to measure advertising. We do not authorize hosting, email, or text-message providers to use your information for their own marketing, and we do not share inquiry or membership information with other IconFit locations. Google and Meta may use information collected by their own tags as described in their policies and in our Privacy Policy.
User Submissions
You agree that information you submit is true and current, and that you have the right to provide the email address and phone number. You will not submit unlawful, misleading, or infringing content, probe or interfere with the Site, or use the Site to send spam. We may reject or delete a submission and suspend access to the Site if you violate these Terms.
Intellectual Property
The Site and its content, including text, images, logos, schedules, and the IconFit name, are owned by IconFit or its licensors and are protected by intellectual-property laws. You may view and print pages for your personal, non-commercial use. You may not copy, scrape, or use our names or marks without prior written permission. Photographs on the Site may be representative of another IconFit location and may not depict the facility in its current condition.
Membership and Facility Use
These Terms govern use of the Site only. Joining IconFit, entering the facility, taking a class, training with staff, or redeeming a day pass is governed by a separate membership or guest agreement and any waiver presented at the facility or in a membership system. Nothing on the Site is an offer that we must accept, a promise of a particular fitness result, or a guarantee that a class, amenity, promotion, or hour of operation will remain available. Schedules, offers, pricing, and hours may change.
Disclaimer of Warranties
The Site is provided “as is” and “as available.” To the fullest extent permitted by California law, IconFit disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that information on the Site is complete or current.
Limitation of Liability
To the fullest extent permitted by California law, IconFit and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of your use of, or inability to use, the Site, even if we have been advised of the possibility. Our total liability for a claim arising out of the Site or these Terms will not exceed one hundred dollars ($100) or the amount you paid us specifically to use the Site, whichever is greater. This section does not limit liability for gross negligence, fraud, or willful misconduct, or any liability that cannot be limited under California law. It does not replace a waiver that applies to use of the facility.
Indemnity
You will defend, indemnify, and hold harmless IconFit and its members, managers, and staff from third-party claims, damages, and reasonable attorneys’ fees arising out of your misuse of the Site, information you submit, or your violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.
Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Subject to the small-claims exception below, the state courts located in Los Angeles County, California, and the federal courts of the Southern District of California, are the exclusive venue for a dispute arising out of the Site or these Terms, and you consent to personal jurisdiction there. Either party may bring an individual claim in small claims court. To the extent permitted by law, you and IconFit waive a jury trial. Nothing in these Terms waives a non-waivable right under California law, including a right to seek public injunctive relief where that right cannot be waived.
Changes to these Terms
We may update these Terms by posting a revised version on the Site and changing the effective date. If a change is material, we will also post a notice on the Site. Your continued use of the Site after the updated Terms are posted is your acceptance of the revised Terms. Text-message consent you already gave remains in effect until you revoke it, and it is governed by the disclosure presented when you consented.
